Welcome to BookMyPuja, an online platform operated by INFINIX AI Pvt Ltd ("we," "us," or "our"), a company registered under the laws of India. These Terms and Conditions ("Terms") govern your use of the BookMyPuja website, mobile application, and related services (collectively, the "Service").

Please read these Terms carefully before using our Service. By accessing or using the BookMyPuja platform, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use our Service.

DEFINITIONS

  • "Service" refers to the BookMyPuja platform, including the website, mobile application, and all related services.
  • "User" or "you" refers to any individual or entity that accesses or uses the Service.
  • "Temple" refers to any religious institution that partners with BookMyPuja to offer puja services through our platform.
  • "Puja" refers to any religious ritual, ceremony, offering, or service that may be booked through our platform.
  • "Platform Fee" refers to the fee charged by BookMyPuja for facilitating the transaction between Users and Temples.

PLATFORM DESCRIPTION

BookMyPuja is an online platform that enables Users to book pujas, rituals, and other religious services offered by affiliated Temples across India. We act solely as an intermediary that facilitates the connection between Users and Temples. BookMyPuja is not responsible for conducting any religious ceremonies or rituals.

USER ELIGIBILITY

  1. You must be at least 18 years of age or have the legal capacity to enter into contracts to use our Service.
  2. By using our Service, you represent and warrant that you have the legal capacity to accept these Terms.
  3. We reserve the right to refuse service to anyone, for any reason, at any time.

ACCOUNT REGISTRATION

  1. To access certain features of our Service, you may need to register for an account.
  2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  3. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  4. You are solely responsible for any activities conducted through your account, whether or not authorized by you.
  5. You must notify us immediately of any unauthorized use of your account or any other breach of security.

BOOKING PROCESS

  1. Booking Confirmation: All bookings made through our platform are subject to confirmation by the respective Temple. We do not guarantee that all booking requests will be accepted or fulfilled.
  2. Booking Details: You are responsible for providing accurate booking details, including but not limited to names, dates, and specific requirements for the puja. Inaccurate information may result in the inability to perform the puja as requested.
  3. Cancellation: Cancellation policies vary by Temple. Please refer to the specific cancellation policy associated with your booking. BookMyPuja reserves the right to charge cancellation fees in accordance with the Temple's policy.
  4. Rescheduling: Requests for rescheduling are subject to the availability of the Temple and may incur additional charges.

FEES AND PAYMENT

  1. Puja Fees: The cost of each puja is determined by the respective Temple and is clearly displayed on our platform before booking.
  2. Platform Fee: BookMyPuja charges a platform fee for facilitating the transaction. The fee structure is as follows:
    • For bookings between ₹50 and ₹500: A flat fee of ₹10
    • For bookings between ₹501 and ₹5000: A flat fee of ₹20
    • For bookings above ₹5000: A flat fee of ₹30
  3. Payment Methods: We accept various payment methods as displayed on our platform during the checkout process.
  4. Payment Processing: All payments are processed securely through authorized payment gateways. BookMyPuja does not store your payment card details.
  5. Taxes: All applicable taxes will be included in the final price displayed at checkout.
  6. Receipt: An electronic receipt will be sent to your registered email address upon successful payment.
  7. Refunds: Refund policies vary by Temple. In general, refunds will be processed according to the Temple’s policy and may be subject to deductions for administrative fees. The platform fee is non-refundable except in cases where the puja service could not be performed due to fault on the part of BookMyPuja or the Temple.

PRASAD DELIVERY

  1. Delivery Responsibility: The delivery of prasad (sacred offerings) to devotees is solely the responsibility of the Temple. BookMyPuja acts only as a platform facilitating the booking of pujas and related services.
  2. Delivery Timeframe: The Temple will make reasonable efforts to ensure timely delivery of prasad. However, delivery times may vary based on location, weather conditions, and other factors beyond our control.
  3. Delivery Address: You are responsible for providing accurate delivery information. BookMyPuja and the Temple are not responsible for non-delivery or delay due to incorrect address information.
  4. Delivery Areas: Prasad delivery may be limited to certain geographical areas as determined by the Temple. Please check the availability of delivery services before making a booking.
  5. Delivery Status: Any inquiries regarding the status of prasad delivery should be directed to the Temple directly. Contact information will be provided in your booking confirmation.
  6. Quality and Condition: The Temple is solely responsible for the quality, preparation, and condition of the prasad. BookMyPuja makes no representations or warranties regarding the quality, quantity, or condition of the prasad delivered.

USER OBLIGATIONS

  1. You agree to use our Service in compliance with all applicable laws and regulations.
  2. You agree not to:
    • Use our Service for any illegal purpose
    • Interfere with or disrupt the operation of our Service
    • Attempt to gain unauthorized access to any part of our Service
    • Impersonate any person or entity
    • Provide false or misleading information
    • Use our Service to transmit any harmful content
  3. You acknowledge that the fulfillment of puja services is subject to the Temple’s rules, customs, traditions, and availability.

INTELLECTUAL PROPERTY

  1. Our Content: All content on our platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and data compilations, is the property of BookMyPuja or its content suppliers and is protected by Indian and international copyright laws.
  2. Temple Content: Information, images, and descriptions related to Temples and their services are provided by the respective Temples and remain their intellectual property.
  3. Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Service for personal, non-commercial purposes.
  4. Restrictions: You must not:
    • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information obtained from our Service
    • Use any content from our Service for commercial purposes without obtaining a license from us or our licensors

PRIVACY POLICY

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and disclose information about you when you use our Service.   1. Intermediary Status: BookMyPuja functions solely as an intermediary platform connecting Users with Temples. We are not responsible for the actual performance of pujas, rituals, or other religious services.
  2. Temple Services: The performance of pujas, rituals, and other religious services is the sole responsibility of the respective Temple. BookMyPuja makes no warranties or representations regarding the efficacy, quality, or spiritual significance of any puja or ritual performed.
  3. Disclaimer of Warranties: To the maximum extent permitted by law, our Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  4. Limitation of Liability: To the maximum extent permitted by law, BookMyPuja and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
    • Your use of or inability to use our Service
    • Any unauthorized access to or use of our servers and/or any personal information stored therein
    • Any interruption or cessation of transmission to or from our Service
    • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service
    • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through our Service
  5. Exclusive Remedy: If you are dissatisfied with any aspect of our Service or these Terms, your sole and exclusive remedy is to discontinue using our Service.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless BookMyPuja, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms.

We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Service or any part thereof with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

These Terms constitute the entire agreement between you and BookMyPuja regarding our Service and supersede all prior agreements and understandings, whether written or oral, regarding our Service.
